1. Introduction, scope and acceptance

These Terms of Use govern access to https://www.fyndit.app, the dashboard, Discord interfaces and all Fyndit features published by Teddy VALENTIN, trading as VALENTIN TEDDY.

Use of the Service constitutes acceptance of the Terms then in force. Purchasing a paid plan is also subject to the Terms of Sale. The Privacy Policy explains personal-data processing. If documents conflict, specific terms displayed at checkout prevail over the Terms of Sale, which prevail over these Terms of Use.

2. Definitions

  • "Fyndit" or the "Service": the website, dashboard, bots, alerts, monitoring tools, filters, automations and related features;
  • "User": anyone accessing the Service, free of charge or under a subscription;
  • "Account": the account and credentials used to access the Service, including through Discord;
  • "Third-Party Platform": any external service used with Fyndit, including Vinted, Discord and Whop;
  • "Subscription": a paid Plus or Pro plan purchased for a monthly or three-month billing period.

3. Nature and role of Fyndit

Fyndit is a technical monitoring, alerting and decision-support tool. Depending on the selected plan, it may provide real-time alerts, filters, automated offers or other automation described on the website.

Fyndit is independent from Vinted. It is not affiliated with, authorised, sponsored or endorsed by Vinted and does not act on its behalf. Fyndit does not sell any item, is not a party to transactions on Third-Party Platforms and does not warrant the availability, authenticity or conformity of listings or goods.

4. Access, capacity and Account security

Some features require a Discord Account and paid plans require an order managed with Whop. Users must have legal capacity to contract. A minor may subscribe or use a purchasing feature only with the permission and under the responsibility of a legal representative, subject to the relevant Third-Party Platform's rules.

Information provided must be accurate, complete and current. Accounts are personal. Users must protect credentials, sessions and access tokens, must not share them, and must promptly report unauthorised access to contact@fyndit.app. Activity from an Account is presumed to come from its holder unless shown otherwise.

5. Permitted and prohibited use

Users may use Fyndit only for their own needs, within their plan limits, the law and the rules of Third-Party Platforms.

  • circumventing plan limits, security measures or access controls;
  • sharing, reselling, renting or transferring an Account or access without written permission;
  • bulk extraction, copying, decompilation, modification or attempted reconstruction of Service code or data, except where mandatory law permits it;
  • using Fyndit to defraud, mislead, harass, infringe third-party rights or commit an offence;
  • disrupting the Service, introducing malware, overloading infrastructure or testing vulnerabilities without permission;
  • using data, accounts or payment methods without the holder's permission.

6. User obligations

Users undertake to use the service lawfully and to comply with the terms of Vinted, Discord and Whop. Fyndit is independent from Vinted and is not affiliated with, authorised, sponsored or endorsed by Vinted.

Users are solely responsible for configuring their rules, filters, sessions, automations and accounts and for the listings, messages, offers, purchases, sales and other actions they choose to carry out. Fyndit provides the technical tool but does not grant users a mandate, enter into contracts for them or take part in their transactions with third parties.

7. Licence and intellectual property

Subject to these Terms, Fyndit grants the User a personal, limited, non-exclusive, non-transferable and revocable licence to access the Service for the duration of their right to use it.

The Service, code, databases, structure, interfaces, documentation, text, visuals, logos and distinctive signs are protected. No ownership right is transferred to the User. Third-Party Platform trademarks and content remain the property of their owners.

8. Third-Party Platforms and services

Fyndit depends in part on Vinted, Discord, Whop, networks, browsers and other third-party services. They have their own terms, may change their interfaces, restrict or interrupt services, and remain responsible for their own performance.

A Third-Party Platform change, outage, suspension or decision may reduce or prevent Fyndit features without automatically constituting a breach by Fyndit. Fyndit cannot guarantee that a Third-Party Platform will accept or perform an automation.

9. Availability, maintenance and changes

Fyndit is provided on a reasonable-efforts basis. Interruptions may occur for maintenance, updates, security, incidents, high demand or third-party dependencies. Fyndit will use reasonable efforts to restore the Service and, where possible, give notice of significant planned downtime.

Fyndit may develop and change Service features. A material change affecting a current paid plan will be handled in accordance with mandatory rights applying to digital services.

10. Suspension and Account closure

Users may stop using the Service and request Account closure at contact@fyndit.app. Ending a Subscription is governed by the Terms of Sale and does not necessarily require immediate deletion of data subject to legal retention duties.

Fyndit may suspend access immediately in an emergency or in cases of fraud, security risk, non-payment or serious breach, or after reasonable notice for another remediable breach. The User will be informed of the reason and available challenge mechanisms where required by law.

11. Liability and no guarantee of earnings

Fyndit does not guarantee any purchase, sale, income, margin, gain, item availability or particular speed. Examples of results are illustrative, individual and non-representative.

Users remain solely responsible for settings, sessions, accounts, offers, messages, purchases, sales, tax and business duties, and verification of goods and counterparties. Fyndit is not responsible for a decision, transaction, sanction or loss caused by a User's act or a Third-Party Platform.

Nothing excludes liability that cannot legally be excluded or statutory consumer guarantees. In relations solely with business Users and to the extent permitted by law, Fyndit is not liable for indirect loss and its aggregate liability is capped at the fees excluding tax paid by that User during the 12 months preceding the event giving rise to the claim.

12. Evidence and communications

Electronic records, logs, Whop confirmations, Discord messages and emails retained with reasonable security may serve as evidence of access, orders and communications, subject to proof to the contrary.

Service communications may be sent to the linked email or Discord Account. Users must keep those contact details current.

13. Personal data

Fyndit's Privacy Policy describes personal-data processing, cookies, recipients, retention periods and individual rights.

14. Force majeure

Neither party is liable for delay or non-performance caused by force majeure within Article 1218 of the French Civil Code. The affected party will give reasonable notice and seek to limit the effects.

15. Changes to these Terms

Fyndit may amend these Terms for legal, technical or functional changes. The applicable version is dated. Material changes will be notified by an appropriate means before taking effect where required. No change deprives a consumer of rights attached to an existing contract.

16. Severability and waiver

If a provision is invalid or unenforceable, the remaining provisions continue in effect. A delay in exercising a right does not waive that right.

17. Support, governing law and disputes

Questions or complaints may be sent to contact@fyndit.app. These Terms are governed by French law without depriving consumers of mandatory protections in their country of residence.

The parties will first seek an amicable solution. Consumers may use the mediator identified in the Terms of Sale free of charge. If no agreement is reached, the competent courts are determined by applicable law; no exclusive territorial jurisdiction is imposed on consumers.
